A legal obligation and a strategic asset

Article L330-3 and its implementing decree of April 4, 1991 require all forms of contractually-organized and branded commerce (franchising, commission-affiliation, associated commerce, brand licensing, etc.) to provide an EGM in the event of an exclusivity or quasi-exclusivity commitment.

Before signing any contract, a complete DIP, including an updated EGM, must be given to the candidate. You must respect the legal deadline of 20 days. This minimum period may be extended to allow for better assimilation of information.

The main bodies governing the sector :

  • Fédération Française de la Franchise (FFF): representing franchisors and franchisees.
  • Fédération du Commerce Coopératif et Associé (FCA): representing the central organizations and members.
EGM: A LEGAL OBLIGATION FOR FRANCHISORS
